Property Settlements for married and de facto couples

Parties to a marriage are able to apply to the Family Court or Federal Magistrate’s Court to make a determination with regard to a property settlement. The approach of these Courts to property settlements is to determine the net assets of the parties to the relationship, examine the financial and non-financial contributions of the parties, and consider a variety of other factors, which may relate to the circumstances of the individual case. The court then delivers a judgment, which divides the marital assets between the parties on a final basis.
